Terms and Conditions

1.1 Agreement to these Terms

These Website Terms & Conditions (“Terms”) are a legal agreement between you and Wellington Auto Service (“we,” “us,” “our,” or the “Shop”) governing your access to and use of wellingtonautoservice.com (the “Site”), including our online appointment request forms, contact forms, review displays, and any AI-powered or automated features made available on the Site. By accessing or using the Site, submitting a form, or requesting an appointment, you agree to these Terms. If you do not agree, do not use the Site. Our Privacy Policy, Cookie & Tracking Technologies Policy, Disclaimer, and Accessibility Statement are incorporated into these Terms by reference.

1.2 Who we are

Wellington Auto Service is an independent, family-owned automotive repair facility doing business in Wellington, Palm Beach County, Florida. Our business address is 3103 Fortune Way #1, Wellington, Florida 33414; our telephone number is (561) 790-2886; and our email address is info@wellingtonautoservice.com. Our hours of operation are Monday through Friday, 7:30 a.m. to 5:30 p.m., and closed Saturday and Sunday, excluding holidays and weather-related closures. We are an independent repair shop: we are not affiliated with, sponsored by, or endorsed by any vehicle manufacturer or dealership, and manufacturer and brand names are used on the Site only to identify the vehicles we service.

1.3 Eligibility

The Site is intended for use by individuals who are at least eighteen (18) years of age and who can form a binding contract under applicable law. The Site is not directed to children, and we do not knowingly collect personal information from children under 13. See Section 2 (Privacy Policy) for details.

1.4 Acceptable use

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use in connection with obtaining or evaluating repair services. You agree not to: (a) use the Site for any unlawful purpose; (b) submit false, misleading, or impersonating information; (c) attempt to access non-public areas of the Site, our networks, or our service providers’ systems; (d) interfere with the Site’s operation, introduce malware, scrape or harvest data, or place unreasonable load on our infrastructure; (e) reverse engineer or copy any part of the Site except as expressly permitted; (f) use automated tools to submit forms, generate fake appointments, or manipulate reviews or advertising metrics; or (g) use the Site in any way that violates the rights of any third party.

1.5 Appointment requests and scheduling

Submitting an appointment request, contact form, or text message through the Site is a request, not a confirmed booking or a contract for repair work. An appointment is confirmed only when we contact you to confirm it. Appointment availability shown or implied on the Site is an estimate. Some issues require a diagnostic inspection before we can provide an accurate estimate, and some vehicles require special-order parts or manufacturer-specific tooling. We may decline any job, including for safety, capacity, legal, or parts-availability reasons.

1.6 Estimates, authorization, pricing, and payment

All pricing information published on the Site — including service descriptions, “starting at” figures, specials, coupons, and online estimates — is provided for general information only, is illustrative and non-binding, and does not constitute a binding offer or a quoted price for your specific vehicle. Your price is established by a written or oral estimate based on the actual condition of your vehicle.

Repair work is performed under the Florida Motor Vehicle Repair Act, sections 559.901–559.9221, Florida Statutes. Among other things, Florida law provides that if the cost of repair work will exceed $150, the shop must prepare a written repair estimate and present you with a written disclosure statement before diagnostic work or repairs; that a copy of the estimate and disclosure must be given to you before work begins; that you cannot be charged in excess of a specified amount without your written or oral approval; that a motor vehicle repair shop must prepare and provide an invoice as required by section 559.911, Florida Statutes; and that storage charges generally may not accrue for three (3) working days after you are notified that the repair is complete. Nothing in these Terms waives any right you have under the Florida Motor Vehicle Repair Act or any other applicable consumer-protection law, and any provision of these Terms that conflicts with those rights does not apply to the extent of the conflict.

Diagnostic charges, shop-supply and disposal charges, and the basis for estimating charges are disclosed in the estimate as required by law. Payment is due upon completion of the work unless we agree otherwise in writing. We accept most credit cards, debit cards. If you do not pay for completed and authorized repair work, we may exercise any remedy available to us under Florida law, which may include a lien on the vehicle and storage charges, subject to applicable notice requirements.

1.7 Parts, additional findings, and customer-supplied parts

Unless you instruct us otherwise in writing, we may use new, remanufactured, rebuilt, reconditioned, or original-equipment-equivalent parts. Where a vehicle has been driven extensively or has been modified or previously repaired by others, we may discover additional conditions that were not reasonably apparent when the estimate was prepared; we will contact you for authorization before performing additional work. If you supply your own parts, we are not responsible for their quality, fitment, or failure, and any warranty we offer on our labor may be limited.

1.8 Limited repair warranty

Repairs we perform are backed by our  parts-and-labor warranty, commencing on the date of the invoice, applicable to the specific repair performed and the parts we supplied, and subject to the written warranty terms provided with your invoice and the exclusions stated on the Site. Except as stated in that warranty and as required by applicable law, we make no other warranty, express or implied, regarding repair services or parts. Nothing in these Terms limits any warranty or remedy you have under applicable law, including the Magnuson-Moss Warranty Act where it applies, or any implied warranty of workmanlike performance arising under Florida law.

1.9 Text messages, calls, and electronic communications

If you provide a telephone number, you consent to receive calls and text messages from us relating to your appointment, estimate, and service (and, only where you have separately opted in, marketing messages). Message frequency varies; message and data rates may apply. You can opt out of text messages at any time by replying STOP, and you can request help by replying HELP. Consent to receive marketing texts is not a condition of purchasing any service. Where we send marketing text messages, we obtain the prior express written consent required by the federal Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA), sections 501.059, Florida Statutes, and we honor revocation of consent promptly, by any reasonable means, including reply STOP, email, or a phone call to (561) 790-2886. Calls to and from our shop may be recorded or transcribed for quality and training purposes where permitted by law.

1.10 Reviews, submissions, and other user content

You retain ownership of content you submit to the Site (such as a comment, photo, or review). By submitting it, you grant us a worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, display, distribute, and adapt that content in connection with our business, including on the Site, in marketing, and in advertising. You represent that you own or control the rights to the content you submit and that it is accurate. We will not publish fake or incentivized reviews, we do not pay for reviews, and we do not suppress negative reviews. Reviews and ratings shown on the Site may be served by a third-party review platform and may include reviews originally posted on Google; those reviews reflect the individual customer’s own experience and are not a prediction of your results. Please do not submit sensitive personal information (for example, financial account numbers, driver’s license numbers, or medical information) through any general Site form.

1.11 Intellectual property

The Site and its contents — including text, layout, graphics, photographs, illustrations, video, logos, and code — are owned by us or licensed to us and are protected by copyright, trademark, and other laws. You may view and print pages for your own non-commercial reference. You may not copy, reproduce, republish, distribute, modify, or create derivative works from the Site’s content for commercial purposes without our prior written permission. Vehicle manufacturer and brand names and logos are the trademarks of their respective owners and are used on the Site for identification purposes only. Some imagery on the Site may be illustrative, stock, or generated with the assistance of AI tools and may not depict actual customers, vehicles, or facilities; see our Disclaimer.

1.12 Third-party sites, widgets, and services

The Site includes features and content provided by third parties — for example, an embedded reviews widget, map and direction links, scheduling or booking software, payment processing, chat or AI assistant tools, and analytics and advertising tags. Those services are governed by their own terms and privacy policies, and we are not responsible for their content, availability, or practices. See the Privacy Policy for the categories of providers we use and the Cookie Policy for the tracking technologies they set.

1.13 AI tools and automated interactions

The Site may use AI (artificial intelligence) and automated tools, including AI chat assistants, automated phone answering, call transcription and summarization, AI-assisted content and image generation, and AI-assisted advertising optimization. Where you interact with an automated assistant about a commercial transaction, we disclose that you are interacting with an automated system and not a human. AI outputs can be incomplete, outdated, or incorrect and are not a repair estimate, a diagnosis, or a professional opinion about your vehicle. Always confirm price, availability, diagnosis, and safety-critical information with a member of our staff by telephone at (561) 790-2886. See Section 2.6 for how we handle data in connection with AI tools.

1.14 Accessibility

We are committed to making the Site usable by everyone, including people with disabilities. Our accessibility statement, conformance target, and the ways to report a barrier are set out in our Accessibility Statement. If any part of the Site prevents you from obtaining information or services, contact us at (561) 790-2886 or info@wellingtonautoservice.com and we will provide the information or service through an alternative means.

1.15 Disclaimers

The Site and all content on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, except where such warranties cannot be disclaimed under applicable law. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses, or that any information on the Site (including pricing, availability, hours, or service descriptions) is complete, current, or accurate. Additional disclaimers specific to pricing, reviews, third-party content, and AI-assisted content appear in our Disclaimer, which forms part of these Terms.

1.16 Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of use, arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars ($100).

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for fraud, willful misconduct, gross negligence, or personal injury caused by our negligence, and nothing in these Terms limits your rights under the Florida Motor Vehicle Repair Act, the Florida Deceptive and Unfair Trade Practices Act (FDUTPA), or any other consumer-protection statute.

1.17 Indemnification

You agree to indemnify, defend, and hold harmless Wellington Auto Service and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and reasonable expenses (including attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the Site, or content you submit to the Site.

1.18 Governing law, venue, and dispute resolution

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles. Before filing any formal action, you and we agree to try in good faith to resolve the dispute informally by contacting info@wellingtonautoservice.com with a written description of the issue and a 30-day period to resolve it.

Optional arbitration clause — confirm with Florida counsel before publishing. To the extent permitted by applicable law and subject to the carve-outs below, you and we agree that any dispute that is not resolved informally will be resolved by final and binding individual arbitration administered in Palm Beach County, Florida, and that claims may be brought only in an individual capacity and not as a class or representative action. This paragraph does not apply to: (a) claims that qualify for small claims court; (b) claims for injunctive or equitable relief; (c) claims that cannot lawfully be arbitrated; or (d) any claim under the Florida Motor Vehicle Repair Act or other statute that prohibits pre-dispute arbitration. You may opt out of this arbitration clause by sending written notice to [BUSINESS EMAIL] within thirty (30) days after you first agree to these Terms. If you would prefer not to bind customers to arbitration, delete this paragraph and rely on the venue provision below.

Subject to the paragraph above, you and we submit to the exclusive jurisdiction and venue of the state and federal courts located in Palm Beach County, Florida, and waive any objection based on forum non conveniens.

1.19 Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms or that your use creates risk or legal exposure. Sections 1.10 through 1.18 survive termination.

1.20 Changes to these Terms

We may update these Terms from time to time. The version posted on the Site, with its “Last updated” date, governs your use from that date forward. Material changes will be highlighted on the Site for a reasonable period. Your continued use of the Site after an update means you accept the revised Terms.

1.21 General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the incorporated policies, are the entire agreement between you and us regarding your use of the Site.
